Terms of Service

These Terms of Service (“Terms”) set out the terms and conditions under which Clouder makes its services available and under which the Customer uses them. They apply to all services offered by Clouder: domain name registration and management, web hosting, virtual private servers (VPS), email solutions, Google Workspace and any related service.

Any order, subscription or use of a Clouder service implies the Customer’s unreserved acceptance of these Terms.

By creating an account or placing an order, the Customer acknowledges having read these Terms and accepts them in full.

Clouder reserves the right to amend these Terms at any time to reflect changes in its services or in applicable regulations.

The applicable terms are those in force on the date the service is used. The Customer is invited to regularly check the most recent version published on clouder.ma.

Clouder provides infrastructure and online-presence services for individuals and businesses. Each service is described on the site at the time of order, with its technical specifications, duration and pricing.

.ma domain names are registered and managed in accordance with ANRT’s naming decision and the applicable specific terms.

The Customer agrees to provide accurate, complete and up-to-date information when creating an account, and to update it promptly in case of any change.

The Customer is solely responsible for the confidentiality of their credentials and for any activity carried out from their account.

Clouder cannot be held liable for unauthorized access resulting from the Customer’s negligence in protecting their credentials.

The Customer must immediately notify Clouder of any unauthorized use of their account.

The Customer agrees to use the services in accordance with the law, these Terms and applicable good practice.

The Customer must not host or distribute any unlawful, infringing, defamatory content, or content that breaches public order or third-party rights.

The Customer must not use the services to send unsolicited email (spam), phishing, malware, or any activity that compromises network security.

The Customer is solely responsible for the content they publish, store or transmit through the services.

In case of serious breach or manifestly unlawful content, Clouder may suspend or terminate the relevant service, without notice where security, regulation or third-party rights so require, and without this giving rise to any right to a refund.

Clouder may also suspend or terminate a service in case of abusive use of the services or of support by the Customer, or where the Customer makes requests that exceed the scope of the services offered by Clouder as an accredited provider.

Service pricing is shown on the site at the time of order, in the displayed currency and, where applicable, exclusive or inclusive of tax as indicated.

Payment is made at the time of order via the payment methods offered by Clouder. The service is activated once payment is confirmed.

In case of non-payment by the due date, or of payment delayed by more than thirty (30) days, Clouder may suspend and then terminate the relevant service, after notifying the Customer, without such termination giving rise to any compensation whatsoever in favor of the Customer.

Clouder reserves the right to change its pricing; new pricing applies to renewals and new orders.

Services are subscribed for the term chosen at order and renew according to the terms specified for each service.

Clouder notifies the Customer of the upcoming expiry of their services and allows them to renew before expiration.

The Customer may terminate a service at any time from their client area or by contacting support, subject to the terms specific to each service.

Any refund terms are governed by Clouder’s Refund Policy.

Clouder takes reasonable measures to ensure the availability and continuity of its services, without guaranteeing the complete absence of interruptions.

Interruptions may occur due to planned maintenance, security updates, or causes beyond Clouder’s control (force majeure, third-party failure, etc.).

Clouder cannot be held liable for indirect damages, data loss not attributable to Clouder, or the Customer’s use of the services.

It is the Customer’s responsibility to maintain their own backups of data used within the services.

All elements comprising Clouder’s site and services (trademarks, logos, interfaces, text, documentation) are protected by intellectual property rights and remain the exclusive property of Clouder or its partners. Any unauthorized reproduction or use is prohibited.

The Customer retains full ownership of the content and data they process using the services.

Processing of the Customer’s personal data is governed by Clouder’s Privacy Policy, in accordance with law 09-08 on the protection of individuals with regard to the processing of personal data. That policy details the data collected, its purposes, its recipients, and the Customer’s rights and how to exercise them.

These Terms are governed by Moroccan law. In the event of a dispute concerning their interpretation or performance, and absent an amicable resolution, the competent courts of Rabat shall have jurisdiction.
